OVERVIEW
Welcome to Pokécado! Pokécado is an online shop operated by Pokécado Kaufmann, a sole proprietorship based in Gossau SG, Switzerland. The terms "we", "us" and "our" refer to Pokécado Kaufmann. We operate this shop and website, including all related information, content, features, tools, products and services (the "Services"). Pokécado is powered by Shopify, which enables us to provide the Services to you.
The following Terms of Service, together with all policies referenced herein (the "Terms"), describe your rights and obligations when using the Services. Please read them carefully, as they contain important information about your rights, including on cancellation, warranty and liability.
By visiting or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use our Services.

SECTION 1: ACCESS AND ACCOUNT
There is no minimum age for purchases. Persons under 18 should obtain their parents' permission before placing an order.
To use the Services, in particular to place orders, we require certain information such as your email address as well as billing, payment and shipping information. You confirm that all information you provide is accurate, current and complete.
You are solely responsible for the security of your login credentials and for all activity in your account. You may not transfer, sell, assign or license your account to any third party.

SECTION 2: OUR PRODUCTS
We sell exclusively original Pokémon Trading Card Game products in English, German, French and Japanese editions, as well as single cards. Sealed products are delivered in their original packaging.
We strive to display our products accurately. Colours and appearance may differ from what is shown depending on your device and screen settings. Product images are for illustrative purposes only.
The contents of booster packs are random. The cards you pull do not constitute a defect.
For graded cards, we adopt the grade assigned by the respective grading company (e.g. PSA). We make no warranty regarding their assessment.
We reserve the right to modify product descriptions at any time, to remove products from our range, and to limit quantities per person or household.

SECTION 3: ORDERS AND CANCELLATION
By completing an order, you submit a binding offer to purchase. The contract is concluded upon our order confirmation by email. We may refuse or cancel orders at our own discretion, for example in the event of pricing errors, stock issues or violations of purchase limits. In this case, we will notify you by email and fully refund any amounts already paid.
Information on cancelling an order you have placed can be found in our Cancellation Policy. Returns and exchanges are governed exclusively by our Refund Policy.
For high-demand products, a limit per household applies, as stated on the product page. We will cancel orders that circumvent this limit, for example through multiple accounts, names or addresses. Anyone who deliberately circumvents the limit will also be excluded from future sales of such products. In that case, we will also cancel all future orders from this person for products with a limit per household and refund any amounts already paid in full. Raffles are subject to the respective published terms of participation.
If an order is not paid within the stated payment period, we may cancel it.
You confirm that your purchases are intended for your personal use or for use within your household and not for commercial resale.

SECTION 4: PRICES AND PAYMENT
All prices are in Swiss francs (CHF). Pokécado Kaufmann is not subject to VAT, so no VAT is shown. Shipping costs are displayed separately at checkout. For Japan imports, we cover the import duties, so there are no additional costs for you.
The price at the time of your order, as stated in your order confirmation, applies. Prices, discounts and promotions may change without prior notice. Promotions may be subject to separate terms, which take precedence in case of conflict.
We accept TWINT, credit cards, Apple Pay and PayPal. Payment is due at the time of ordering. You confirm that you are authorised to use the selected payment method and that all payment information is accurate and complete.

SECTION 5: SHIPPING AND DELIVERY
We deliver exclusively to Switzerland and Liechtenstein. Our Shipping Policy applies.
Stated delivery times are estimates. We accept no liability for delays caused by shipping carriers, customs clearance or other events beyond our control. For pre-orders, the shipping date stated on the product page applies.
If the manufacturer postpones a release or we receive less stock from our supplier than ordered, we will inform you immediately. We will fully refund any orders we are unable to fulfil as a result. Any further claims are excluded in this case.
Ownership and risk pass to you upon handover of the goods to the shipping carrier. Transport damage must be reported directly to the shipping carrier. We only ship goods in flawless condition.

SECTION 6: WARRANTY
If a product has a manufacturing defect, you must report it to us via our contact form within 72 hours of receipt and include photos of the defect. After review, we will, at our option, provide a replacement or refund the purchase price. Any further warranty is excluded to the extent permitted by law.

SECTION 7: INTELLECTUAL PROPERTY
Our Services, including texts, images, graphics, logos and their design, are the property of Pokécado Kaufmann or our licensors and are protected by Swiss and international law.
You may use the Services solely for your personal, non-commercial use. Without our prior written consent, you may not reproduce, distribute, modify, make publicly available or create derivative works from any content of the Services.
The Pokécado name, logo and design are marks of Pokécado Kaufmann. Pokémon and all associated names are trademarks of their respective owners. Pokécado is not an official partner of The Pokémon Company. The Shopify name and logo are trademarks of Shopify.

SECTION 8: OPTIONAL TOOLS AND EXTERNAL LINKS
The Services may include third-party tools and links to external websites. We have no control over these tools and websites and accept no liability for their content, products or services. Use is at your own risk. Please direct any questions or complaints to the respective third party.

SECTION 9: RELATIONSHIP WITH SHOPIFY
Pokécado Kaufmann is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our shop are made directly with Pokécado Kaufmann. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pokécado Kaufmann, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all liability for any claims, damages, and liabilities arising from or related to your purchases and transactions with Pokécado Kaufmann.

SECTION 10: PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy. Certain information is also subject to Shopify's Privacy Policy, which can be viewed here. As the Services are hosted by Shopify, information you submit is shared with Shopify and third-party providers, which may also be located outside Switzerland.

SECTION 11: FEEDBACK AND REVIEWS
If you submit ideas, suggestions, reviews or other feedback to us, you grant us a perpetual, royalty-free right to use and publish it and to use it for improving and promoting our Services. We are under no obligation to keep feedback confidential, to provide compensation for it, or to respond to it.
Your feedback must not infringe any third-party rights and must not contain unlawful, offensive or misleading content. We may edit or remove feedback that violates these Terms.

SECTION 12: ERRORS AND INACCURACIES
Information in the Services may occasionally contain typographical errors, inaccuracies or omissions, for example in product descriptions, prices, shipping costs, delivery times or availability. We reserve the right to correct such errors at any time and to cancel affected orders, even after you have submitted your order. In this case, we will fully refund any amounts already paid.

SECTION 13: PROHIBITED USES
You may use the Services only for lawful purposes. In particular, you are prohibited from (a) using the Services for unlawful or malicious purposes, (b) infringing intellectual property rights, (c) harassing or harming others, (d) providing false or misleading information, (e) impersonating another person, (f) transmitting viruses or other malicious code, (g) using bots, scraping tools, automated processes or AI tools to access the Services or to place orders, or (h) circumventing or manipulating security or protective measures of the Services, such as captchas or queues.
We reserve the right to cancel orders and suspend accounts at any time if we determine a violation of these Terms.

SECTION 14: LIABILITY
We are only liable for damages we have caused intentionally or through gross negligence. Any further liability, in particular for indirect damages, consequential damages and lost profits, is excluded to the extent permitted by law. The information in the Services is provided for general information purposes only, and we make no warranty as to its accuracy or completeness.

SECTION 15: INDEMNIFICATION
You agree to indemnify Pokécado Kaufmann and Shopify against all third-party claims arising from your violation of these Terms, applicable law or the rights of third parties.

SECTION 16: TERMINATION
We may terminate your access to the Services at any time and without prior notice. Any amounts due up to that point remain owed. Provisions which by their nature continue to apply beyond termination, in particular those regarding intellectual property, liability, indemnification and governing law, shall survive.

SECTION 17: FINAL PROVISIONS
If any provision of these Terms is invalid, the validity of the remaining provisions shall not be affected. If we do not enforce a right, this shall not constitute a waiver of that right. These Terms, together with our published policies, constitute the entire agreement between you and us. You may not transfer any rights or obligations under these Terms to third parties without our written consent. Headings are for convenience only.

SECTION 18: GOVERNING LAW AND PLACE OF JURISDICTION
These Terms are governed exclusively by Swiss law. The place of jurisdiction is Gossau SG, subject to mandatory statutory places of jurisdiction for consumers.

SECTION 19: CHANGES TO THESE TERMS
The current version of these Terms can be viewed on this page at any time. We may amend these Terms at any time. Orders are governed by the version published at the time the order was placed.
